BREEDER REPLACEMENT AND HEALTH CONTRACT

voluntarily enter into and agree to all terms delineated in this contract as witnessed by their signatures below.

BREED/SHOW PROSPECT TERMS

hereinafter referred to as "Puppy" has been sold to Buyer by Seller as "Breed/show prospect". Breed/show prospect shall be understood to mean that no disqualifying cosmetic faults as defined in the AKC Pembroke Welsh Corgi standard are evident at time of sale and further that no genetic disorders are immediately apparent.

I. Should Puppy develop any disqualifying faults as defined in the Pembroke Welsh Corgi Standards, or be diagnosed with any genetically derived medical disorder which is attested to by two unassociated veterinarians, thereby causing Buyer and Seller to agree that Puppy cannot ethically be bred, Seller will, upon provision of veterinary reports and, where applicable,

Orthopedic Foundation for Animals (OFA) report, or Canine Eye Registration Foundation (CERF) certification, provide Buyer with one of the following options.

A) Should Buyer choose to keep Puppy and accept refund, Seller will refund 50% of purchase price________________. Puppy must be spayed or neutered before refund check will be issued, and spay/neuter certificate must be provided to Seller by Buyer's veterinarian of choice.

B) Should Buyer choose to relinquish ownership of Puppy to Seller, Seller will refund purchase price less any shipping or miscellaneous charges necessary for transportation of Puppy to Seller.

C) Should Buyer choose to keep Puppy and accept a replacement breed quality puppy, Buyer must pay pet price ($600) and any shipping or miscellaneous charges associated with transport of replacement puppy. Upon receipt of spay/neuter certificate and $600 Seller will provide a replacement breed quality puppy as soon as such a puppy is available to Seller.

II. Seller shall not be held responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders which are due to Buyer's negligence.

III. Buyer agrees that Puppy shall not be used for breeding purposes until Orthopedic Foundation for Animals (OFA) Certification of hips has been received. Buyer will forward a copy of OFA Certification to Seller upon receipt. Seller strongly recommends that hips be certified with OFA and that The Canine Eye Registration Foundation (CERF) provides certification of eyes.

HEALTH GUARANTEE

I. Seller guarantees that Puppy is in good health and has received appropriate medical inoculations and care including parvo inoculations and worming. Seller will provide Buyer with a medical chart detailing treatment Puppy has received under Seller's care, and future care Seller feels is essential to Puppy's well being.

II. Seller guarantees that Puppy is free of life threatening diseases or disabilities (i.e., heart murmurs, parvo, etc.) for 72 hours after delivery to Buyer. Should life threatening diseases or disabilities be discovered by Buyer within 72 hours after receipt of Puppy, and attested to in writing to Seller by Buyer's veterinarian, Seller will provide Buyer with a replacement breed quality puppy as soon as such a puppy is available to Seller, or refund 100% of purchase price $________. Seller strongly recommends that Buyer have Puppy examined by a licensed veterinarian of Buyer's choice within 72 hours of receipt of Puppy.

PURCHASE PRICE AND SHIPPING

1. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $________,

to be paid as follows: $_______deposit on execution of the Agreement

with the balance of $_________ to be paid on or before the puppy/dog leaves the Seller's premises. If the balance is not paid

by _______________________, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.

2. If delivery is requested by Buyer, it shall be by air-freight, C.O.D. to a designated location. Buyer is solely responsible for costs of crate, insurance during shipment , and cost of freight charges. If Seller has to purchase crate prior to shipping, Buyer shall re-imburse Seller in full for this cost or per-pay if possible.

GENERAL

I. Corgi Puppy will carry the Pleasantstone FARM (as a prefix or suffix) kennel name

II. Buyer agrees to allow Seller the right of first refusal should Buyer decide to sell, relinquish or transfer Puppy.

III. The Buyer agrees that the puppy will NOT be left alone in a backyard or kennel Only. The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or "tied out". This Corgi is sold with the understanding that it was to go to a select home, socialized properly, and become a member of the family. We recommend that the buyer attends basic obedience classes with their P.W.C. The Pembroke Welsh Corgi excels in obedience, agility, herding and tracking. They are a social dog that thrives on attention and work as well as being a beloved member of the family.

This Agreement is made and signed by both parties to insure the well being and protection of this Pembroke Welsh Corgi. If any part of this Agreement is breached, the Seller is released from any further obligations hereunder

IV. Should Buyer choose to break any of the covenants of this Agreement, the remainder of the Agreement will be considered null and void, and Seller will have the right to repossess Puppy.

A) Buyer and Seller agree that this Agreement will be governed by the laws of the State of Oregon and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller.
